ATTAWAY Clerk of Circuit Court of Calhoun County, Florida Legal Notice CONCURRENT NOTICE NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS August 31, 2011 City of Blountstown 20591 Central Ave West Blountstown, FL 32424 (850) 674-5488 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Blountstown. REQUEST FOR RELEASE OF FUNDS On or about September 15, 2011 the City of Blountstown will submit a request to the Florida Department of Community Affairs for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act, as amended, to undertake a project to address the existing Mayhaw Street lift station; it does not have the necessary freeboard, causing the pumps to malfunction. As part of the renovations, the pump station will be replaced with a larger diameter station (8’ diameter) of adequate depth. Additionally the City intends to replace the following water mains. Azalea Drive – 1,000 LF of new 6” PVC water main. Ridge Avenue – 500 LF of 6” PVC water main. If funding is available, the City would life to resurface Camelia Avenue as well as install 500 LF of new 6” water main and rehab 450 LF of gravity sewer. Based on funding availability, the City would also like to pave Janet Street as well as install a new pressure sewer collection system along this road. The total project cost is estimated at $689,072. FINDING OF NO SIGNIFICANT IMPACT The City of Blountstown has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Blountstown City Hall, 20591 Central Ave. West, Blountstown, FL 32424, and may be examined or copied weekdays 8A.M to 4 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Blountstown. All comments must be received by September 15, 2011. Comments will be considered prior to the City of Blountstown requesting a release of funds. Comments should specify which notice they are addressing. RELEASE OF FUNDS The City of Blountstown certifies to the Florida Department of Community Affairs and HUD that Winston Deason in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Blountstown to use the CDBG funds. OBJECTIONS TO RELEASE OF FUNDS DCA will accept objections to its release of fund and the City of Blountstown certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Blountstown; (b) the City of Blountstown has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Florida Department of Community Affairs, CDBG Program, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100. Potential objectors should contact the City of Blountstown to verify the actual last day of the objection period. Winston Deason, Mayor Legal Notice Notice and Public Explanation of a Proposed Activity in the 100-Year Floodplain and Wetland To: All interested Agencies, Groups and Individuals This is to give notice that the City of Blountstown has conducted an evaluation as required by Executive Orders 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 to determine the potential affect that its activity in the floodplain and wetland will have on the environment. The City of Blountstown intends to undertake a project to be funded by a Florida Small Cities Community Development Block Grant. The City of Blountstown is interested in alternatives and public perceptions of possible adverse impacts that could result from the project as well as potential mitigation measures. The existing Mayhaw Street lift station does not have the necessary freeboard, causing the pumps to malfunction. As part of the renovations, the pump station will be replaced with a larger diameter station (8’ diameter) of adequate depth. Additionally the City intends to replace the following water mains. It has determined that it has no practicable alternative other than to proceed with the work. This activity will have no significant impact on the environment for the following reasons: All of the proposed work will be constructed within the existing right-of-way. Best Management Practices shall be employed to prevent erosion. Although the project is located in the 100?year floodplain, the improvements cannot be undertaken in any other location due to the scope of the project. There is, therefore, no practicable alternative. The proposed improvements conform to applicable floodplain protection standards. The proposed action will not affect natural or beneficial floodplain values, and residents of the community will benefit from the project. The proposed waterline replacements will allow these line segments to provide fire flow protection to these areas. The lift station replacement on Mayhaw Drive will bring the station into compliance with FDEP standards and will help in preventing future lapses in service at this station. Failure to provide these improvements could result in fines and penalties to the City of Blountstown from the Florida Department of Environmental Protection. Additional agencies involved in this project include the Florida Department of Community Affairs and the U.S. Department of Housing and Urban Development. The Florida Dept. of Environmental Protection, the U.S. Fish and Wildlife Service, and the Army Corp of Engineers have reviewed the project for environmental impacts and have issued the necessary permits or exemptions.
